These terms and conditions outline the rules and regulations for the use of Taktikx Sports (OPC) Pvt Ltd's Website, located at https://taktikx.com.
By accessing this website, we assume you accept these terms and conditions. Do not continue to use Taktikx if you do not agree to take all of the terms and conditions stated on this page.
Taktikx – Users Terms and Conditions
1. General
1.1. These Terms and Conditions (“Terms”) govern the participation, conduct, and rights of all kind of users (“User(s)”) registered on the Taktikx platform (“Company” / “Platform”). User(s) , here, includes both service providers and service recipients.
1.2. By registering or accepting any booking through the Platform, the User agrees to comply with these Terms and all policies, rules, and instructions issued by the Company.
1.3. The Company acts solely as a digital facilitator connecting Users (“Users”) for the purpose of organizing and participating in acitivity/games or sports activities.
1.4. The Company does not own, control, or supervise any actual acitivity/gameplay or on-ground activity, and shall not be responsible for any act, omission, or dispute between Users.
2. User Eligibility and Verification
2.1. Only individuals aged 18 years and above are eligible to register as Users.
2.2. Users must complete all Know Your Customer (KYC) and verification processes as required by the Company.
2.3. Users shall provide only accurate and verifiable information during registration and are responsible for keeping such information updated.
2.4. The Company reserves the right to deny or revoke registration at its discretion, without obligation to disclose reasons.
3. User Responsibilities
3.1. Users must reach the venue at least 15 (fifteen) minutes before the scheduled booking time.
3.2. Users shall start the activity/game only after entering the One-Time Password (OTP) provided through the Platform.
3.3. Users shall accept booking requests within one (60) Minutes, failing which penalties may apply.
3.4. If a confirmed activity/game is cancelled by the User, a cancellation fee or penalty may be imposed.
3.5. Users must bring their own required equipment, including one backup item.
3.6. Users shall behave in a disciplined, professional, respectful, and non-abusive manner throughout the activity.
3.7. Users shall not consume alcohol, narcotics, or any intoxicating substance before or during the activity/game.
3.8. Users are solely responsible for their own safety, health, and belongings during any activity/ gameplay.
3.9. Users shall maintain professional conduct with Users, avoiding personal, physical, or offensive behaviour.
3.10. Users shall minimize use of the other’s personal equipment unless essential.
3.11. Users shall immediately report any incident, injury, or dispute through the Platform’s reporting system.
3.12. Users shall not misrepresent themselves as Company employees, agents, or representatives.
3.13. Users shall not share any personal contact details with Users outside the Platform without consent.
3.14. In case a one cannot play/participate, the User shall assist, instruct, or guide them where feasible.
3.15. Users shall not solicit tips, donations, or personal payments from other Users outside the Platform.
4. Payment, Wallet, and Refunds
4.1. All payments shall be processed through the Platform’s in-app wallet system.
4.2. The wallet is a virtual representation of balance and not a bank account.
4.3. Amounts shall be credited after the User ends the activity/game session in the app.
4.4. The Company will deduct applicable commissions, service fees, and taxes before crediting payment.
4.5. Refund Clause: The Company shall make reasonable efforts to process refunds or payment reversals , within 15 days, upon valid request through the Platform. In case of delay, error, or failure, the Company shall not be liable for any loss or inconvenience.
4.6. Payments are processed via third-party gateways, and timelines depend on their systems.
4.7. The Company may withhold payments for investigation in cases of disputes, fraud, or non-compliance.
4.8. Promotional offers, bonuses, or incentives are discretionary and subject to change.
4.9. The User shall be responsible for any bank or transaction charges incurred during transfer.
4.10. The Company shall not entertain refund claims after 7 (seven) days of transaction.
5. Code of Conduct and Prohibited Acts
5.1. Users shall not engage in violence, harassment, discrimination, or obscene conduct.
5.2. Users shall not use offensive language or make personal comments about a User’s gender, caste, religion, or background.
5.3. Users shall respect venue property and follow local ground rules.
5.4. Users shall not record, photograph, or post images/videos of others Users or venues without permission.
5.5. Users shall not encourage other Users to book outside the Platform (“off-platform dealing”).
5.6. Any violation of this clause may result in suspension, penalty, or permanent termination.
6. Safety, Security, and Emergencies
6.1. Users shall maintain awareness of their surroundings and avoid risky activity/play that may cause harm.
6.2. In case of injury or emergency, Users shall immediately inform the Company and local authorities.
6.3. The Company shall not bear any medical or insurance liability for Users.
6.4. Users are advised to have personal health or accident insurance coverage.
7. Technical and Operational Limitations
7.1. The Platform may be temporarily unavailable due to maintenance, updates, or technical issues.
7.2. The Company shall not be liable for any missed booking, payment delay, or loss arising due to such downtime.
7.3. Users must use the latest version of the app to ensure smooth operation.
8. Fraud, Misuse, and Penalties
8.1. The Company reserves the right to investigate and penalize any User involved in fraudulent activities, false bookings, or manipulation of data.
8.2. Fraud includes, but is not limited to, fake check-ins, fake OTP usage, collusion, or duplicate accounts.
8.3. In such cases, the Company may forfeit wallet balance, withhold future payments, and pursue legal action.
9. Confidentiality and Data Protection
9.1. Users shall treat all other User and Company information as strictly confidential.
9.2. Users shall not share, copy, or misuse any personal data for personal gain.
9.3. Data collection and processing will follow the Company’s Privacy Policy and applicable data laws.
10. Intellectual Property
10.1. All app content, software, text, trademarks, and graphics belong exclusively to the Company.
10.2. Users shall not reproduce, modify, or distribute any material without prior written consent.
11. Advertising and Publicity
11.1. Users shall not use the Company’s name, logo, or brand for personal advertising.
11.2. Any promotional material using the Company’s name requires prior written approval.
12. Non-Solicitation and Relationship
12.1. Users shall not directly or indirectly solicit other Users to engage in activity/games or events outside the Platform.
12.2. The relationship between the User and Company is independent and non-employment-based. Nothing in these Terms shall be construed as creating any partnership or employment relationship.
13. Termination and Suspension
13.1. The Company may suspend, block, or terminate a User’s account at any time in case of:
Policy violation;
Misconduct or non-performance;
Fraudulent activity;
Safety or legal concerns.
13.2. Termination shall not affect the Company’s right to recover penalties or dues.
13.3. Users may voluntarily delete their account through the app, subject to settlement of outstanding obligations.
14. Dispute Resolution
14.1. Any dispute arising between the User and the User shall first be reported through the Platform.
14.2. The Company will make reasonable efforts to mediate or resolve disputes internally.
14.3. If unresolved, such disputes shall be governed by the laws of India and subject to the exclusive jurisdiction of courts in [Insert City, e.g., Mumbai, India].
15. Communication and Notices
15.1. All notices, updates, and communications from the Company shall be sent via email, SMS, or in-app notifications.
15.2. Users are deemed to have read and accepted such communications upon delivery.
16. Limitation of Liability
16.1. The Company’s liability, if any, shall be strictly limited to the amount of commission received for the specific transaction.
16.2. The Company shall not be liable for indirect, incidental, or consequential damages arising from the User’s participation or use of the Platform.
17. Modification of Terms
17.1. The Company reserves the right to modify, amend, or replace these Terms at any time without prior notice.
17.2. Continued use of the Platform after such modification shall be deemed as acceptance of the revised Terms.
18. Severability and Waiver
18.1. If any provision of these Terms is held invalid, the remaining provisions shall continue in effect.
18.2. The failure of the Company to enforce any right shall not constitute a waiver of such right.
19. Governing Law
19.1. These Terms shall be governed and interpreted in accordance with the laws of India.
